"Travel banned" sue the state
The first case will be considered in the end of this week.
"The interrogation in the Central district court on the complaint against the Interior Ministry and the Ministry of Justice is appointed on April 6", -- the Belarusian Helsinki Committee's head Aleh Hulak says to Euroradio.
The human rights activist received a
response from the Office of Citizenship that he cannot leave the country as he
should bear responsibility under a civil lawsuit. No
more details.
"The
note stated that someone had filed a civil action against me. And
that’s all".
This
will be the first process of the kind. Other
figures of the "list of the restricted to travel abroad," have not
made it to the courts yet and correspond with the Ministry of Justice, the
Interior Ministry, prosecutors' offices and local offices of Citizenship and
Migration.
"I got a reply from the prosecutor’s
office literally on Saturday - some blatant evasion, such an irritating
nonsense. Like,
we have laws and they are enforced. There is nothing even to comment
upon"- says opposition member Viktar Karnyaenka.
On Thursday, he filed a complaint against the Ministry of Justice in court to find out whether it is legal to ban him from leaving the country. Karnyaenka says that he will address even the UN.The UN Committee on Human Rights recognized that Karnyaenka was right in his disputes with the Belarusian State three times. However, it did not affect anything.
However, Stanislau Shushkevich is not going to complain.
"I don’t file complaints. We do not live in a state of law. And
I know what they will answer me. So I don’t waste time on it and try to find
another way to get out of here and to return here. I returned from the United
States the day before yesterday. "
As for re-elected UCP leader Anatol Lyabedzka, he cannot make it without complaints. After being detained in Vorsha, he was left without even a passport, so now he is determined to go to court.
"I appealed to the Minister of
Justice Slizheuski. I want to know why the Ministry included my name into
the database of persons who are currently restricted to travel abroad. I am waiting for an answer. "
Another issue is compensation of the price of wasted tickets. It can be a considerable amount of money. In the case of the recently detained at the border – Lyabedzka, Atroshchankau and Kalyakin – it makes Br 7,000,000. The "restricted to travel abroad” say that they are going to wait for the court’s decision with regard to the travel ban first. If this case is resolved in favor of the applicants, they will claim for compensation of all losses.
