Struggle against “MTS” eggs may continue in other countries
The struggle with “MTS” eggs is likely to continue in other countries where the trademark is being distributed. The Belarusian patent attorney dealing with the case of “MTS” and eggsquares Yuliya Klimkouskya told ERB that the registration of the trademark was probably annulled because it was an Easter symbol.
According to Yuylya Klimkouskaya, the Exarchate confirmed that a red egg was an Easter symbol and its usage as a trademark could insult believers. That’s why, in Ms. Klimkouskaya’s opinion, “MTS” was forbidden to use a red egg but white eggs were allowed.
Yulіya Klіmkouskaya: “So we took the passage mentioning that a red egg was an Easter symbol and added a reference to the law on trademarks (“Absolute refusal to register a trademark”) saying that things considered as symbols, terms, etc. could not become registered trademarks”.
If Ms. Klimkouskaya is right, other countries where the “Mobile TeleSystems” company works may also fight for the cancellation of a red egg as a logo of “MTS”. The countries are Russia, Ukraine, Uzbekistan and Turkmenistan.
Yulіya Klіmkouskaya: “Ms. Haranskaya, the curator of the eggsquares project, wants to go the whole hog. As far as I understand, it will not only be in Belarus but in Ukraine and in… If “MTS” does not try to arrange it with them”.
One of the authors of eggsqaures Victar Markavets told ERB that “MTS” had not tried to arrange it with them.
Vіktar Markavets: “Speaking about the Belarusian “MTS”, we could even present the symbol to them. But nobody has tried to contact us and to discuss it yet…”
Let us remind you that a poet Ales Razanau and an artist Victar Markavets tried to dispute the registration of the trademark in Belarus. The authors referred to the fact that their series “Eggsquares” with similar symbols was created and published in 1992.
The appeal council of the national centre of intellectual property decided that a red egg in a white square was an eggsqure while a white egg in a red square was the logo of “MTS”.
At the same time the director of the affiliate of “MTS” in Belarus Dzmitry Hodas is sure that nobody will forbid them to use “the egg in the square” as a trademark.
Dzmіtry Hodas: “Besides the fact that the authors said that it was an eggsqaure, there were many other arguments they mentioned in order to annul the registration. According to the today’s court decision, the appeal council does not consider it to be an eggsquare. We are waiting for the reasons of the decision according to which the registration of the red egg was not considered to be valid”.
The arguments will be ready in two months. The decision of the appeal council will become valid in six months. That’s why both sides still have time to appeal the decision.
